Terms of service

These terms apply to every assignment Ground Insights Uganda accepts. Where a signed contract with a client says something different, the contract takes precedence.
1. What we agree to do
We carry out the assignment described in the written scope you approve. The scope names the location, the questions to be answered, the method, the deliverables and the date. Anything not in the scope is not part of the engagement until we both agree a variation in writing.
2. Price and payment
Prices are set in Ugandan shillings. Where the site shows a price in another currency, that figure is an estimate for your convenience; your quotation states the exact amount and the currency you will be charged in, and where it is not shillings, the exchange rate used. The quoted price is fixed for the approved scope and includes standard local travel. Assignments requiring exceptional travel, and any official search fee charged by a registry or public office, are quoted as separate lines and agreed with you in writing before the work is carried out. Work begins once the required payment is received or, for account clients, once a purchase order is issued. Smaller verification assignments are payable in full before the assignment starts. Larger or multi-site investigations are payable fifty per cent on acceptance of the quotation and the remaining fifty per cent once fieldwork is complete, with the final report released on settlement of that balance. Additional locations, repeat visits caused by circumstances outside our control, or scope changes are quoted separately before they are carried out.
3. What the fee is for
The fee is payment for the investigation and the reporting, not for any particular outcome. It does not guarantee a favourable finding, a confirmation that a business or property is what it was said to be, or the approval of any transaction. We report what the evidence and information available within the agreed scope support. A completed assignment that could not confirm what you were told has been properly performed and is chargeable in full.
4. What we report
We report what our researcher observed and what people on site told us, and we distinguish clearly between the two. We state plainly what we could not confirm and why. We do not guarantee that a finding will remain true after the date of the visit, because circumstances on the ground change.
5. What this is not
Our reports are factual field observations. They are not legal advice, not a title opinion, not a valuation, not an audit and not a credit decision. You remain responsible for the decision you take. Where a matter needs a licensed advocate, surveyor, valuer or auditor, we will say so rather than stray into it.
6. Lawful conduct
We work within Ugandan law. We will not impersonate an official, trespass where entry is refused, obtain documents unlawfully, or record anyone where doing so would be unlawful. If an assignment cannot be completed lawfully or safely we will stop, tell you immediately, and refund the unperformed portion.
7. Confidentiality
We treat your identity as the commissioning party, the brief and the findings as confidential. Our researchers sign a confidentiality undertaking before their first assignment. We will not disclose that you commissioned a check unless you instruct us to or the law compels us.
8. Ownership and use
On full payment, the report and the evidence gathered for your assignment are yours to use for the purpose you commissioned them. We retain a copy in our evidence vault for the retention period set out in the privacy policy, so that a disputed finding can be checked against the original record.
9. Liability
Our liability for any assignment is limited to the fee paid for that assignment, except where the law does not permit such a limit. We are not liable for losses arising from a decision you take on the basis of a report, or from information that was accurate on the date of the visit and changed afterwards.
10. Cancellation
You may cancel before a researcher travels and receive a refund less any costs already committed. Once a researcher has travelled, the visit is chargeable whether or not access was obtained, because the cost was incurred. We will always tell you in advance when that point is reached.
11. Complaints
If you believe a finding is wrong, tell us and we will re-examine the original evidence record and respond in writing. Where we were wrong, we will correct the report and, where appropriate, re-do the work at our cost.
12. Governing law
These terms are governed by the laws of Uganda, and the courts of Uganda have jurisdiction over any dispute arising from them.
